End of Life Choices - 820 Words

End of Life Choices Over the course of the semester, we have covered many interesting topics in this class. However, the one that I continually struggled to form a solid opinion on, and sincerely had to ponder what my decisions would be in the given situations, was the topic of end of life choices. My own personal thoughts and beliefs would conflict with my religious following, and my mind would continually change on such topics as whether or not physician assisted suicide should be legal, or whether or not I would want to keep living in a persistent vegetative state in the hope of a miracle recovery. Besides this, if the multisource assessment were used, then it would help the person to judge their traits and know, what society thinks of him. However, as a negative side, it may so happen that false or improper response is given for the surveyed person, which will lead to improper computation of interpersonal traits. With the increasing number of people committing crimes it is not surprising to read that an increasing number have been committed by children. Tragedies such as those that occurred in Littleton, Colorado and Little Rock, Arkansas, have generated heightened concern over bloodshed amongst Americas young. The anger and pain provoked by these highly publicized displays of juvenile violence have been reflected in the words and deeds of politicians who call for tougher approaches to crime and increasingly severe criminal sanctions. As a result, the juvenile justice system, founded on the idea that childhood is a distinct stage of life, has slowly been dismantled. The century-old notion of children and adolescents as less culpable and more amenable to rehabilitation has given way to a harsher reality where child criminals are frequently indisting uishable from their adult counterparts. Since 1992, forty-five states have passed or amended legislation making it easier to prosecute juveniles as adults (Childrens Rights; Speaking for Children. P. 2). Not only are more children being transferred out of the juvenile system and into the adult criminal system, but also today, more juveniles are receiving the ultimate sanction-the death penalty. In January 2000 three juvenile offenders were put to death. As of October 2000, seventy-four more awaited their fate on death row (Msn:Death Penalty Info Center; p.8). . This assessment is aiming to outline the marketing strategies of the â€Å"A Bathing Ape† company from several viewpoints. A Bathing Ape Company, which formed and took off in Japan, they manufacture a mixture of products and service on a global scale. Nigo, a Japanese DJ founded the company in 1993. The brand popularity was one of main purpose of their success, even though they have a high pricing policy. However, their supplies are not equal to their demands their customers desired product and their production is limited. Therefore the buyer has to be fast in deciding if he wants the product before it goes out of stock. A Bathing Ape targets the hip hop and fashion scene (Rocherfort). People use A Bathing Ape products to their advantage as their constantly changes their products in stores, which makes consumers trade A Bathing Ape products. Kid Cudi (the rapper) used to work at A Bathing Ape store in New York until he made it big in the hip-hop industry. Kid Cudi now has teamed up with Nigo and they use Kid Cudis fame to their marketing advantage. They also release special edition t-shirts at these events. The A Bathing Ape Company also operates Bape Hair Salon and they have cafes known as â€Å"Bape!? † They also have futuristic designed shops with designed glass displays and gives technological shopping experiences. A Bathing Ape was one of the first companies to introduce Kevlar clothing into urban wear as a product. Nigo’s designs foreshadowed the urban hip-hop style that has come to prevail as a dominant youth fashion in Japan. A Bathing Apes product, place, price and promotion will be discussed more in depth. A Bathing Ape makes products such as toys, jeans, bags, monogrammed condoms, Iphone cases, underwear, watches, t-shirts, polo’s and shoes. A Bathing Ape clothing is well recognized because of its flashy designs and original artwork. The company also has unique packaging for their products. They introduced the Tee Box, which is a glass metal box which polo shirts come in and have other t shirts in free hanging boxes. A Bathing Ape always collaborates with other brands to combine products. Some companies that A Bathing Ape has collaborated with is Pepsi, M*A*C, and Carhartt. The logo and theme were derived from the original movie â€Å"Planet of the Apes. † A Bathing Apes logo can be found on all of their products. As A Bathing Ape offers the market a wide range of products such as dog clothing to sunglasses it can attract a large market. Nigo labeled â€Å"Ape Shall Never Kill Ape† on most of his products when he was first becoming recognized. Nigo gave his products to famous Japanese artist to wear during their performances to increase the brands exposure. What makes A Bathing Apes products so valuable is that they don’t mass-produce like other companies. A Bathing Ape does not only offer products to the market but services as well. The codification provides us first with guidance in Section 810-10 for identifying Variable Interest Entities. The formation is a VIE because it has 1 of the characters described in section 810-10-15-14.  The first of these is if the total equity investment at risk is not sufficient to permit the legal entity to finance its activities without additional subordinate financial support. Part 1 of the section describes this as entities significantly sharing in profits and losses such as in the creation of Jupiter. The agreement would not apply to the second subsection because they have voting rights, absorb losses and benefit from gains. Lastly the agreement would not apply to section 3 because both Saturn and Venus have voting rights proportionate to their obligations. Thus the formation created Jupiter, a Variable Inte rest Entity, and established Saturn and Venus as Variable Interest holders since they share in the obligation and benefits of the returns. In determining the primary beneficiary we turn to FIN 167, which was released in the Accounting Standards Update 2009-17 to update the previous guidance provided in FIN 46(R). The previous guidance was updated to include the concept of power when determining the primary beneficiary. Initially, the absorption of losses and benefit in gains was sufficient. Using this updated guidance we determine whether Saturn or Venus is a primary beneficiary. Statement 167 provides two characteristics they must possess. The first of these is the power to direct activities of a variable interest entity that most significantly impact the entities economic performance. In the case of shared power, there would be no primary beneficiary. The two parties do share power to direct activities; however, since Saturn has the ability to appoint of remove the CEO, make calls for capital contributions, admission of new joint members, and mergers and acquisitions with a majority vote I would argue that they have t he ability to direct activities that most significantly affect the financial performance of Jupiter. Because of this power, Saturn would be determined to have power. The second characteristic of a primary beneficiary is the obligation to absorb losses of the entity that could potentially be significant or to the right to receive benefits that could be significant. Given the 51% interest in the profits and losses of Jupiter, and the initial investment of over $500 million Saturn has potential significant gains or losses. Both Saturn and Venus have an obligation to absorb gains and losses; however, only Saturn has the power to control the activities that significantly impact the entity’s financial performance and as a result is the primary beneficiary. Saturn needs to  consolidate Jupiter into its financial statements. 4.Other Possibilities Following the guidance from Statement 167 can also lead to a different answer regarding the determination of a primary beneficiary. The paragraph regarding shared power allows no recognition of a primary beneficiary if the power to direct activities actually is shared. One could argue that this is the case in the formation of Jupiter since Venus controls all the decisions regarding distributing clothing in fulfillment of sales. This is a significant amount of power that could significantly impact the entity’s economic performance. This power would still be in effect regardless of the majority vote decisions. In the instance of shared power, no primary beneficiary has to be determined and Saturn would not consolidate Jupiter. Instead, according to section 810-10-50 Jupiter would be disclosed in the notes to the financial statements. Since few people look through disclosures and even fewer understand them, this method would allow the company to shield this entity from investors. 5.Discussion Although either method mentioned above could be supported, I believe it makes more sense for Saturn to consolidate. Its powers as a majority-voting shareholder to decide on the appointment of CEOs make capital contribution calls, admit new members, and conduct merger and acquisition activities are extremely important. Although Venus has the power over distribution decisions, they are still affected by the decisions over which it has no control. Looking at this transaction in terms of substance, it appears that Saturn has included these terms to guarantee their control over the Variable Interest Entity. In conclusion, I believe that Saturn should consolidate Jupiter into its financial information into their overall financial statements.

February 24, 2010 Maggie and Dee; Two Sisters, Two Worlds The genuine appreciation of heritage and family is the focus of Alice Walker’s â€Å"Everyday Use†. Dee and Maggie’s characters are the vessels that Walker uses to demonstrate the difference between appreciating possessions for their usefulness as well as their personal significance and their contrasting value as a trendy, materialistic connection. There is a palpable difference between Maggie and Dee, both in physical appearance as well as in personality traits and their treatment of the personal artifacts that come into play within the story is very telling of this. Maggie, who is self-conscious of her appearance, and will â€Å"stand hopelessly in corners, homely and ashamed of the burn scars down her arms and legs, eying her sister with a mixture of envy and awe† (140) is conscious of the practical uses of the artifacts. From the onset of the story we are made aware of the tenderness that their mother feels towards Maggie. Even in narrating her description of Dee, her thoughts wander back to the memory of their house burning and â€Å"Maggie’s arms sticking to me, her hair smoking, and her dress falling off her in little papery flakes† (141). In addition to her physical flaws, Maggie is described as not being very intelligent. â€Å"Like good looks and money, quickness passed her by† (142). Yet despite what could be considered as unfortunate traits, Maggie is blessed with a kinder, gentler, more likeable persona. Imagine having suffered a tragic, deforming, childhood accident. Then picture a sibling counterpart who is, by all counts, blessed with good-looks and intelligence, and who â€Å"Even her feet were always neat-looking, as if God himself had shaped them with a certain style† (143). It would be understandable to have taken that bad stroke of life’s luck and become a bitter, angry individual. However, Maggie, despite her mousy demeanor, inherits her mother’s rooted nature and appreciation for their heritage. There is no room for pretentiousness in Maggie’s life; it is one of basics; â€Å"She will marry John Thomas (who has mossy teeth in an earnest face)† (142). Maggie who knows how to quilt and chewed checkerberry snuff, already knows what her life has to offer. Her knowledge of her future is derived from her knowledge of her ancestry. There appears to be no rancor in her acceptance of this. When the climactic scene occurs and Dee asks â€Å"Can I have these quilts? † (145), Maggie’s first implied reaction is one of surprise and anger; â€Å"I heard something fall in the kitchen, and a minute later the kitchen door slammed† (145). But as someone â€Å"never used to winning anything, or having anything reserved for her† (146), Maggie succumbs and offers to let Dee have them. Although â€Å"Maggie knows how to quilt† (146), she is able to comprehend the deeper personal value of the quilts, and states that she â€Å"can ‘member Grandma Dee without the quilts†(146). Despite their value as an item of everyday use, the quilts are meaningful to Maggie, much in the way they are to her mother who remembers having quilted them with Big Dee. The scraps, the bits and pieces and â€Å"one teeny faded blue piece, about the size of a penny matchbox, that was from Great Grandpa Ezra’s uniform that he wore in the Civil War. † (145) hold deep significance to Maggie. Dee, on the other hand, is portrayed in a very different light by Walker. Commencing with her physical appearance; â€Å"Dee is lighter than Maggie, with nicer hair and a fuller figure† (141). However, their differences do not end there. Dee is intelligent, ambitious and confident. Even â€Å"At sixteen she had a style of her own and knew what style was† (142). Rather than embracing her family, there is a sense of shame for her impoverished past. â€Å"She wrote me once that no matter where we â€Å"choose† to live, she will come see us. But she will never bring her friends† (143). One can sense that despite Dee’s accomplishments and natural gifts, she is at a loss for identity and is grasping at something to hold on to by attaching herself to the relics that she wants to take away. Part of the reason that her desire to bond to her heritage via the artifacts is questionable is the fact that in the past she shunned her mother’s offer of â€Å"a quilt when she went away to college. Then she had told me they were old-fashioned, out of style† (146). Her integration into a world away from where she grew up has made her conscious of the value of her heritage, but it can be concluded that it is not for the sentimental value that her heritage holds but for the ability to flaunt that heritage to her new social circle. Dee believes that she can appreciate the value of the quilts more than Maggie, who will â€Å"be backward enough to put them to everyday use† (144). Dee wants the quilts for more materialistic reasons. She considers the quilts â€Å"priceless† (144). While both the girls came from the same upbringing and both have a desire to bond to their heritage, the reasoning behind that desire, and the difference in their motives, is indicative of their personalities. Maggie, being the one who suffered at childhood, who wasn’t blessed with beauty and intelligence, has a deeper understanding of where she came from. It was Grandma Dee and Big Dee who taught her how to quilt herself† (146). When Dee was packing up the dasher, wondering who made it, it was Maggie who responded â€Å"Aunt Dee’s first husband whittled the dash†, â€Å"His name was Henry, but they called him Stash† (145). She had a vivid recollection and genuine appreciation of her past. Dee, on the other hand, has until this point been unsuccessful at combining her good graces with a heartfelt recognition of her ancestry and her family ties. She will â€Å"use the churn top as a centerpiece in the alcove table† (145) and when asked what she would do with the quilts she responds, â€Å"Hang them† (146). One can only wonder what would happen to those pieces when the next stylish fad comes along considering her favoring of appearances over substance. Although, there no immediate need to change the current system, Zara should not invest more in the current obsolete IT infrastructure. It should adopt the change to the new OS eventually. Making a gradual change to the new system will increase Zaras efficiency, without facing the sudden setback of implementing the change at once.
